Status Quo and Problems of Intellectual Property Rights of Domestic Packaging Enterprises

Compared with the electronic information industry, packaging The intellectual property work of printing enterprises is inferior. Due to factors such as customer standards and key technologies, packaging and printing enterprises lack the right to speak in new product development, new material research and new equipment improvement. The level is far behind the industries of electronic information and manufacturing, which has caused many difficulties and challenges for the enterprise intellectual property strategy. Therefore, how to break through the predicament and realize the strategic transformation of intellectual property in packaging and printing enterprises is worthy of attention and consideration by every packaging engineering technician and patent workers.

1. Weak awareness of intellectual property protection

The intellectual property work of China's packaging and printing enterprises started late, and the number of patent applications was small. Among them, some enterprises apply for patents only for project declaration, technical achievement appraisal, high-tech enterprise identification and enterprise listing, but ignore the true value and significance of intellectual property, which not only damps the creativity and enthusiasm of the R&D team. And it seriously restricts the long-term development of enterprises. According to the analysis and investigation of the patent applications of China's top 100 printing enterprises, the number of patents with outstanding patent work is less than 100. A few companies have not even applied for a patent. Some enterprises have applied for patents but lack mature patent management. Institutions, patent concepts are relatively vague, such as packaging design such a patent, they believe that even if they apply for a patent, they can not exercise their rights; some companies have concerns about applying for patents to expose their technology, and they will be exposed to their own technical secrets; Some companies think that it takes time, manpower and material resources to apply for a patent, which is not cost-effective. Moreover, patent rights are difficult to apply, and they are reluctant to apply.

Through analysis, the main reason for the above phenomenon lies in two points: First, the leadership of the enterprise does not have a clear understanding of the intellectual property itself, and the business idea of the enterprise still stays at the low level of “making money”, as long as it can make money, or whether it is intellectual property. It doesn't matter, some companies don't even know what intellectual property is. Second, in the packaging and printing industry , whether technology innovation can get revenue is determined by the market, not by intellectual property. These views and concerns are the root causes of the inability of intellectual property to be maximized.

2. The intellectual property management institution is not perfect and the professional talent is lacking.

We know that foreign companies generally have intellectual property departments. For example, there are more than 500 patent engineers in IBM, and nearly one-fifth of Microsoft's 25,000 employees work in intellectual property. The patent engineers of Sony and Hitachi are both There are more than 300 people. In China's packaging and printing industry, few companies set up intellectual property management institutions. Even if such an institution is set up, it is also affiliated with a comprehensive department such as the enterprise scientific research achievement center. There is no special intellectual property office or management personnel. This kind of setting will make the enterprise intellectual property management work more complicated. On the one hand, the staff of the scientific research department can hardly put enough energy into the management of intellectual property rights while taking into account the identification and reward of scientific and technological achievements; On the other hand, intellectual property management involves many professional knowledge and legal issues, and the lack of knowledge of general researchers can ultimately lead to a disadvantage in competition.

In response to the above problems, packaging and printing enterprises must first recognize the importance of intellectual property work in the new situation. Secondly, considering the long-term development of enterprises, they must consciously cultivate their own intellectual property management personnel, or the existing technological achievements of the enterprise. The patent management personnel and the legal personnel of the technical contract are concentrated to carry out systematic intellectual property legal training, and encourage them to participate in the patent agent, trademark agent or lawyer qualification examination, and strive to create a batch of familiar intellectual property law business, High-level compound talents who understand the professional skills of the industry to better serve the enterprise.
